Welcome to Shibbi Car Detail. These Terms of Service ("Terms") govern your use of our website https://www.shibbi.com.au/ (the "Site"), our mobile car detailing services. (collectively, the "Services").
By accessing our Site or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. About Our Services
Shibbi Car Detail - Mobile Detailing Services
We provide professional mobile car detailing services across Sydney, including maintenance detailing, full detailing, interior detailing, ceramic coating application and paint correction.
2. Eligibility
To use our Services, you must be at least 18 years of age, have the legal capacity to enter into a binding agreement, provide accurate and complete information, and not use our Services for any unlawful purpose.
By using our Services, you represent and warrant that you meet these requirements.
3. Account Registration
You may need to create an account to access certain features. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities under your account. You must notify us immediately of any unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Mobile Detailing Services
4.1 Booking and Scheduling
A booking is confirmed only when the customer receives a confirmation email/SMS from the service provider.
By booking online, the customer agrees to these Terms & Conditions.
4.2 Services & Pricing
The final price may change if the actual vehicle condition (e.g., excessive dirt, pet hair, stains, odor) requires additional time or products.
Any price change will be communicated before work begins.
4.3. Access & Location Requirements
The customer must provide safe, legal, and unobstructed access to the vehicle at the agreed time and location (e.g., driveway, street parking with no restrictions).
If the vehicle is parked in a location where mobile detailing is not permitted (e.g., restricted strata/commercial lot), the customer is responsible for obtaining permission.
If the detailer cannot access the vehicle due to locked gates, no parking, or blocked access, a trip fee may apply, or the booking may be cancelled without refund.
4.4 Utilities
The customer must provide access to an external water supply (garden tap or similar) and electricity (standard outlet within 30m of the vehicle).
4.5 Cancellations & Rescheduling
Cancellation / reschedule – at least 10 hours before the appointment.
To cancel or reschedule, the customer must use the online booking system or call/text the number provided in the confirmation.
4.6 Payment
Payment is due on the day of service, either before or immediately after completion, as specified during checkout.
Accepted methods: Credit / debit card ( 2% surcharge ), payID, cash & bank transfer.
4.7 Vehicle Condition & Liability
The detailer will take reasonable care, but the customer agrees that excessive dirt, damage, or wear pre‑existing will be noted (photos may be taken before starting).
The detailer is not liable for:
Pre‑existing paint defects, scratches, clear coat failure, rust, or corrosion.
Damage to loose/unsecured items inside the vehicle (the customer should remove valuables).
Issues arising from non‑disclosed vehicle modifications or fragile components.
In the unlikely event of damage caused directly by the detailer, liability is limited to the cost of the detailing service or repair (at the detailer’s discretion), excluding consequential losses (e.g., lost work time).
4.8. Weather & Unforeseen Circumstances
The detailer may reschedule at no charge if rain, extreme heat, or unsafe conditions (e.g., lightning, smoke) would prevent a proper finish.
The customer will be offered the next available slot or a full refund if no suitable time is found.
4.9 Service Guarantee
The customer must inspect the finished work before the detailer leaves. Any issues must be raised immediately to allow correction on the spot.
Claims made after the detailer has left will be considered on a case‑by‑case basis but are not guaranteed due to possible subsequent contamination (e.g., bird droppings, dust, rain).
4.10. Right to Refuse Service
The detailer may refuse or stop work if the customer is abusive, the vehicle is unsafe (biohazards, needles, broken glass), or access conditions violate these terms. In such cases, a 50% fee may still apply for time and travel.
5. Intellectual Property
5.1 Our Content
All content on our Site, including text, graphics, logos, images, product descriptions and photographs and videos , are owned by Shibbi Car Detail or our licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our Site for personal, non-commercial purposes. You may not copy, modify, or distribute our content, use our content for commercial purposes, remove any copyright or proprietary notices, or attempt to reverse engineer any software.
5.3 Trademarks
"Shibbi Car Detail” and associated logos are trademarks of Shibbi Car Detail. You may not use these marks without our prior written consent.
6. User Conduct
When using our Services, you agree not to violate any applicable laws or regulations, infringe on the rights of others, submit false, misleading, or fraudulent information, interfere with the operation of our Site, attempt to gain unauthorised access to our systems, use our Services to transmit spam or malware, engage in any activity that could damage our reputation.
We reserve the right to refuse service to anyone who violates these Terms.
7. User Content
7.1 Reviews and Feedback
You may submit reviews, comments, and feedback about our Services. By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content. You represent that your content is accurate and does not violate any rights. You acknowledge that we may edit or remove content at our discretion.
7.2 Prohibited Content
You may not submit content that is false, misleading, or defamatory, infringes on intellectual property rights, contains personal information of others, is obscene, offensive, or inappropriate, or promotes illegal activities.
8. Disclaimers
8.1 Service Limitations
For Detailing Services: Results may vary depending on vehicle condition, age, and previous care. We cannot guarantee removal of all scratches, stains, or imperfections. Ceramic coatings provide protection but are not indestructible. Paint correction results depend on paint thickness and conditions.
8.2 Website Availability
Our Site is provided "as is" and "as available". We do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue the Site at any time. We are not liable for any loss resulting from Site unavailability.
8.3 Third-Party Links
Our Site may contain links to third-party websites. We do not control or endorse these websites. We are not responsible for their content or practices. We encourage you to review their terms and privacy policies.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid for the relevant service or product. We are not liable for any indirect, incidental, special, consequential, or punitive damages. We are not liable for any loss of profits, data, or business opportunities. We are not liable for any damage to your vehicle that was pre-existing or caused by factors outside our control.
Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited.
10. Indemnification
You agree to indemnify and hold harmless Shibbi Car Detail, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of our Services, your violation of these Terms, your violation of any rights of a third party, or any content you submit through our Services.
11. Dispute Resolution
If you have a dispute with us, first contact us at shibbibabi@gmail.com to attempt to resolve the issue informally. If we cannot resolve the dispute, either party may refer it to mediation. If mediation fails, either party may pursue legal remedies.
Any legal action must be brought in the courts of New South Wales, Australia.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Site, updating the "Last updated" date, and sending an email for significant changes.
Your continued use of our Services after changes constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shibbi Car Detail regarding your use of our Services.
